Terms and conditions
Terms of sale and services
Version dated 17 October 2026. These terms cover pre-owned furniture and selling or sourcing services offered under the Casa Di Lamotta name on dilamotta.com.
The business
LAMOTTE CORPORATE, a French EURL with share capital of €260,000, registered with the Chaumont Trade and Companies Register under 830 603 890; SIRET 830 603 890 00013. Registered office: 32 rue Victor Mariotte, 52000 Chaumont, France. Contact: contact@dilamotta.com; +33 6 71 06 17 30. These details may also be used for complaints and statutory guarantee claims.
Scope and roles of the parties
Before any commitment, the contract states whether LAMOTTE CORPORATE sells the furniture on its own behalf or acts for an identified third-party seller. It states whether that seller is a trader or a private individual. An agency agreement distinguishes the seller from the intermediary and sets out their respective obligations. Describing the business as an intermediary does not exclude any liability imposed on it by law. Consumer provisions apply to individuals acting outside their trade or profession.
Furniture information
The contractual description identifies the furniture, its brand and model where known, dimensions, materials, condition, disclosed defects, accessories and available supporting documents. Wear on pre-owned furniture must be described; a general “sold as seen” statement does not remove statutory guarantees. Interior or model photographs do not replace photographs of the actual item offered. The buyer receives information specific to that item before purchase. Displaying a brand on the website does not establish an affiliation or certify authenticity.
Formation of the contract
The website has no shopping basket or online payment. A form, telephone call or WhatsApp enquiry is a request for contact and does not by itself place an order. The quotation, order document or agency agreement identifies the essential characteristics, seller, total price, charges, payment, timescale and applicable conditions. The contract is formed by acceptance of the offer under its stated terms. The terms and confirmation are supplied on a durable medium, such as email. Distance-selling and off-premises rules still apply where their legal conditions are met.
Prices, fees and promotions
Consumer prices are stated in euros including taxes under the applicable tax regime. Handling, transport, installation and additional services are priced separately before acceptance. The agency agreement states the fee basis, percentage or fixed amount, any minimum, taxes, the event triggering payment and its due date. No extra charge is imposed without prior agreement. A price reduction does not alter statutory guarantees; its duration, conditions and reference price must comply with applicable rules.
Payment and reservations
Accepted payment methods and due dates are set out in the offer. A reservation takes effect only on the expressly agreed terms; exchanging messages does not by itself secure the item. The contract identifies the legal nature of any advance payment. Unless agreed otherwise, consumer advance payments constitute “arrhes” under Article L. 214-1 of the French Consumer Code. Cancellation consequences depend on that legal classification, without affecting statutory withdrawal rights. No undisclosed penalty is applied.
Selling agency and sourcing services
The written agreement sets out the assignment, duration, any exclusivity, asking price, negotiating limits, remuneration and termination terms. The owner confirms authority to sell and provides accurate information in their possession, including known defects and restrictions. Custody, insurance, travel and transfer of proceeds are specified when entrusted to LAMOTTE CORPORATE. A sourcing request sets out the criteria and budget. No purchase is made in the client’s name without express authority. No sale timescale, achieved price or sourcing outcome is guaranteed unless specifically agreed in writing.
Delivery, collection and receipt
The location, date or timescale, transport price and included services are agreed before sale. The customer discloses known access constraints, including floors, lifts, passage widths and handling needs. Any additional charge requires agreement. For a trader-to-consumer sale, if no date is agreed, delivery takes place without undue delay and within 30 days of the contract. Statutory rights for delayed delivery remain available. Risk passes when the consumer or their nominated third party takes physical possession, except where the consumer independently chooses a carrier not offered by the trader. Report damage promptly and note reservations where possible; failing to do so does not remove statutory guarantees.
Withdrawal: goods and services
For an eligible distance or off-premises contract, consumers have 14 days to withdraw without giving a reason: from receipt of the furniture, or contract conclusion for a service. The starting day is excluded; a deadline falling on a Saturday, Sunday or public holiday or non-working holiday is extended to the next working day. Pre-owned or discounted goods are not excluded on that basis. A contract made on business premises does not automatically give a change-of-mind return right. Send the form below or another clear statement to contact@dilamotta.com or the registered office before the deadline. Prior authorisation is not required. Statutory extensions for missing information remain applicable.
Returns and refunds
Return the goods to the seller or its designated recipient within 14 days after notifying withdrawal, unless collection is offered. Consumers bear direct return costs only if informed before contracting; for furniture that cannot be posted, the cost or a reasonable estimate is disclosed before commitment. Statutory cases requiring trader-funded collection remain applicable. Only diminished value caused by handling beyond what is necessary to examine the goods may be deducted under the legal conditions. Refunds are made within 14 days of notification, including standard delivery charges, using the same payment method unless another fee-free method is expressly agreed. For goods, reimbursement may be withheld until receipt of the goods or proof of dispatch, whichever occurs first, unless the trader has offered collection.
Early performance and exceptions
A service starts before the withdrawal period expires only at the consumer’s express request, recorded on a durable medium where legally required. If the consumer then withdraws, only a proportionate amount for services actually supplied is payable, provided the statutory information and express-request requirements were met. Loss of the right after full performance requires the legally prescribed consent and acknowledgement. The exception for goods made to the consumer’s specifications or clearly personalised does not automatically apply to second-hand furniture, a unique piece or a standard option. Any applicable exception is explained before contracting.
Statutory conformity guarantee
For a trader-to-consumer sale, the seller is liable for non-conformity appearing within 2 years after delivery. For second-hand goods, defects appearing within the first 12 months are presumed to have existed at delivery unless proven otherwise. The consumer may request free repair or replacement; the choice may be refused in legally permitted cases of impossibility or disproportionate cost. Conformity must be restored within 30 days of the request, without significant inconvenience. A price reduction or termination is available in statutory cases, including refusal, delay, failed remedy or a sufficiently serious defect; a minor defect does not justify termination. Repair extends the guarantee by 6 months. Where the consumer chooses repair but the seller imposes replacement, a new 2-year period begins on delivery of the replacement. Statutory suspension periods remain applicable. These rights are exercised against the seller and do not depend on a commercial warranty.
Hidden defects and private sellers
Articles 1641 to 1649 of the French Civil Code cover hidden defects that make goods unfit for their intended use or substantially reduce that use. Proceedings must be brought within 2 years after discovery, subject to statutory limitation rules. Buyers may seek a refund against return of the goods or keep them with a price reduction. For a sale genuinely made by a private individual, the French Consumer Code conformity guarantee does not apply; the hidden-defects guarantee remains available subject to its conditions. The professional intermediary’s own obligations remain separate.
Complaints and mediation
Send a written complaint to LAMOTTE CORPORATE, 32 rue Victor Mariotte, 52000 Chaumont, France, or contact@dilamotta.com, with the contract reference and relevant details. After an unresolved prior complaint, consumers may use consumer mediation free of charge under Articles L. 612-1 et seq. of the French Consumer Code. Mediation does not remove either party’s right to apply to the competent court.
Liability, data and dispute resolution
Each party remains responsible for its obligations under applicable law. No clause limits mandatory guarantees, liability for personal injury, fraud or gross negligence, or consumers’ statutory remedies. Data needed for enquiries and contracts is processed under the website’s privacy policy. French law governs these terms without depriving consumers of mandatory protections of their country of habitual residence where conflict-of-law rules make those protections applicable. Jurisdiction is determined by statutory rules; consumers are not required to use only courts in Chaumont. Translations assist understanding and do not reduce these rights.
Applicable version
The version supplied before acceptance applies to the relevant contract. Later website changes do not retrospectively change existing contracts. Accepted special terms specify the service without overriding mandatory law.
